Terms of Service

The Service is intended for users who are at least sixteen (16) years old, or the minimum age required to consent to digital services in your jurisdiction if higher. If you are under the required age, you may not use the Service. By using the Service, you represent and warrant that you meet the applicable age requirement and that your use of the Service is lawful in your jurisdiction.

Roamo is an AI-powered travel planning, discovery, and itinerary assistance platform. The Service may help users discover destinations, attractions, places of interest, hotels, accommodations, travel ideas, routes, guides, maps, estimated travel times, suggested itineraries, and other travel-related information. Roamo is a planning and discovery tool only. Unless expressly stated otherwise in writing, Roamo is not a travel agency, tour operator, booking provider, merchant of record, hotel, airline, transportation provider, attraction operator, event provider, insurance provider, government authority, visa advisor, medical advisor, legal advisor, financial advisor, or safety authority. Roamo does not directly sell flights, hotels, accommodations, tours, transportation, tickets, attractions, travel insurance, visas, or other travel products or services.

Parts of the Service use artificial intelligence, machine learning, retrieval systems, automated ranking, third-party APIs, public data sources, user-provided information, and other automated systems to generate, summarize, organize, rank, recommend, or display travel information. AI-generated output may be inaccurate, incomplete, outdated, biased, unsuitable, unsafe, or entirely incorrect. AI systems may generate information that appears reliable but is false, outdated, invented, or inconsistent with official sources. You are solely responsible for independently verifying any information before relying on it, including but not limited to opening hours, prices, availability, accessibility, routes, walking distances, travel times, weather conditions, local laws, visa requirements, passport requirements, health requirements, safety conditions, neighborhood safety, transportation options, suitability for children, kosher or religious suitability, accessibility, cancellation policies, and any official or legal requirements. You must always confirm critical information directly with the applicable official source, venue, operator, government authority, booking provider, hotel, airline, attraction, transportation provider, or other relevant third party before booking, paying, traveling, or taking any action.

Roamo does not guarantee that any itinerary, recommendation, attraction, hotel, route, area, destination, guide, AI answer, or other output will be accurate, available, safe, suitable, lawful, accessible, affordable, or appropriate for your needs. Travel involves risks, and conditions may change without notice. You are solely responsible for your travel decisions, personal safety, compliance with laws, suitability assessments, bookings, payments, cancellations, travel documents, health precautions, transportation, accommodation choices, and reliance on any information obtained through the Service. Roamo is not responsible for any decision, loss, cost, injury, missed booking, missed flight, denied entry, cancellation, delay, accident, unsafe condition, legal issue, medical issue, financial loss, or other harm arising from or related to your use of, or reliance on, the Service or any AI-generated or third-party information.

The Service may display, recommend, link to, embed, or otherwise provide access to third-party websites, platforms, booking engines, hotel partners, accommodation partners, travel suppliers, maps, payment processors, AI providers, analytics providers, OAuth providers, content providers, transportation providers, attraction providers, tour providers, travel agencies, affiliate networks, and other third-party products or services (“Third-Party Services”). Some links may be affiliate links, meaning Roamo may receive a commission or other compensation if you click a link, complete a booking, register, or purchase through a third party, at no additional cost to you unless otherwise stated. The inclusion, ranking, display, or recommendation of any Third-Party Service does not constitute an endorsement, warranty, guarantee, or representation by Roamo.

Any booking, purchase, reservation, payment, cancellation, change, refund, credit, rebooking, ticketing, check-in, fulfillment, service issue, overbooking, no-show, damage deposit, resort fee, cleaning fee, local tax, tourist tax, city tax, service charge, or other travel-related transaction is solely between you and the applicable third-party provider, booking partner, payment processor, hotel, accommodation provider, travel supplier, tour operator, airline, transportation provider, or other merchant of record. The applicable third party’s terms, conditions, cancellation policies, refund policies, privacy policies, payment terms, and other agreements govern your transaction. If there is any conflict between these Terms and the terms of a third-party provider regarding a booking, payment, cancellation, refund, fulfillment, change, rebooking, credit, or travel product or service, the third-party provider’s terms will control for that specific transaction. Roamo is not a party to such transactions unless expressly stated otherwise in writing, and Roamo is not responsible for the acts, omissions, prices, availability, policies, failures, delays, cancellations, refunds, credits, overbookings, errors, taxes, fees, service quality, customer support, or disputes of any third party.

If the Service provides tools, links, interfaces, or information that may help you request a cancellation, change, refund, credit, rebooking, or support action from a third-party provider, Roamo does not guarantee that your request will be accepted, processed, approved, or fulfilled. All such requests are subject to the applicable provider’s policies, restrictions, availability, confirmation, deadlines, fees, penalties, fare differences, taxes, local charges, and approval. You are solely responsible for any costs, price differences, penalties, fees, taxes, local charges, currency conversion costs, payment processing fees, and other amounts imposed by third parties.

Prices, availability, ratings, reviews, location data, map data, routes, distances, travel times, opening hours, images, descriptions, fees, taxes, policies, and other travel information displayed through the Service may be provided by third parties, public sources, APIs, automated tools, AI systems, user content, or other data providers. Such information may be incomplete, delayed, inaccurate, outdated, duplicated, mistranslated, misclassified, or may omit taxes, local fees, resort fees, service charges, cleaning fees, deposits, payment fees, or other amounts payable by you. Roamo does not guarantee the accuracy, completeness, timeliness, legality, suitability, or availability of any such information. You must verify all prices, availability, restrictions, policies, and total costs directly with the applicable official source or provider before booking, paying, traveling, or relying on the information.

Some features of the Service may require a paid subscription, paid plan, one-time payment, usage-based payment, credit package, or other fee. Payments for Roamo subscriptions or paid features are processed by Stripe or another third-party payment processor. Roamo does not store your full payment card information. By using paid features, you agree to comply with the applicable payment processor’s terms, privacy policy, and agreements. Paid plans may renew automatically for the billing period selected unless cancelled before renewal. You are responsible for managing and cancelling your subscription before the applicable renewal date if you do not wish to continue. Except where required by applicable law, fees paid to Roamo are non-refundable. Roamo may change prices, features, plan limits, usage limits, or billing terms from time to time, and we will provide reasonable notice of material changes where required by law. You represent and warrant that any payment information you provide is true, accurate, complete, and that you are authorized to use the payment method.

Roamo may establish, modify, or enforce general practices and limits concerning use of the Service, including limits on AI requests, itinerary generation, saved trips, saved places, storage, account activity, API usage, file uploads, message history, retention periods, export options, number of requests, subscription entitlements, rate limits, and other usage restrictions. Roamo may delete, archive, limit, suspend, or fail to store any content, trips, messages, files, itineraries, AI outputs, logs, or other data where required by law, where an account is inactive, where limits are exceeded, where content violates these Terms, where necessary for security or technical reasons, or where necessary to operate or protect the Service. Roamo is not responsible for maintaining backups of your content or data, and you are responsible for exporting or saving any information you need.

From time to time, Roamo may offer promotions, discounts, coupons, credits, referral benefits, trial periods, rewards, cashback, gift cards, limited offers, or other promotional programs. Unless expressly stated otherwise, promotions are non-transferable, may not be combined with other offers, have no cash value, and may be modified, suspended, restricted, revoked, or terminated at any time. Roamo may deny, withhold, revoke, deactivate, or cancel any promotion, credit, reward, trial, discount, or benefit if we believe, in our sole discretion, that you are ineligible, created duplicate accounts, used false information, abused the promotion, violated these Terms, engaged in fraud, cancelled a qualifying transaction, manipulated the Service, used bots, used multiple identities, or otherwise acted in a suspicious or abusive manner. You are solely responsible for any taxes, reporting obligations, fees, or costs arising from any promotion, reward, credit, or benefit. Any rewards provided through third-party vendors are subject to that vendor’s terms, and Roamo is not responsible for any act, omission, expiration, maintenance fee, delivery failure, deactivation, dispute, or other issue relating to a third-party reward provider.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use, attempt to use, or assist anyone else in using the Service in any way that: violates any applicable law, regulation, sanction, export control, court order, or third-party right; is fraudulent, deceptive, misleading, abusive, harmful, harassing, threatening, defamatory, obscene, pornographic, hateful, discriminatory, violent, invasive of privacy, or otherwise objectionable; or infringes intellectual-property rights, privacy rights, publicity rights, contractual rights, or other rights of any person or entity.

You also agree not to: upload, transmit, distribute, or store malware, viruses, worms, scripts, bots, spyware, ransomware, Trojan horses, harmful code, or any software designed to disrupt, damage, intercept, access, or limit the operation of software, hardware, networks, systems, data, or telecommunications equipment; scrape, crawl, harvest, mine, copy, index, train on, bulk-download, extract, cache, mirror, or otherwise collect data or content from the Service without our prior written consent; use robots, spiders, scrapers, crawlers, automated tools, AI agents, browser automation, scripts, or data extraction methods not expressly authorized by Roamo; or reverse engineer, decompile, disassemble, copy, frame, mirror, modify, or create derivative works from the Service or any part of it.

You further agree not to: use the Service, Service content, AI outputs, recommendations, data, rankings, prompts, interfaces, or workflows to develop, train, benchmark, improve, or operate a competing product or service, including a travel-planning, AI itinerary, recommendation, map, attraction, hotel, booking, or travel intelligence product; bypass, remove, disable, degrade, circumvent, or attempt to circumvent any authentication, entitlement, subscription, paywall, rate limit, usage limit, geographic restriction, security feature, block, ban, robot exclusion, API restriction, content protection, or access-control mechanism; or access or attempt to access any account, trip, itinerary, admin area, API, database, system, server, log, source code, credentials, or data that you are not authorized to access.

Finally, you agree not to: impersonate any person or entity, misrepresent affiliation, or create accounts using false, misleading, or unauthorized information; collect, solicit, store, or process personal information of other users without a lawful basis and their consent; solicit personal information from minors; send spam, unsolicited messages, chain letters, advertising, promotions, contests, pyramid schemes, or other unauthorized solicitations; use VPNs, proxies, rotating IP addresses, fake accounts, multiple identities, device spoofing, browser spoofing, or other techniques to evade bans, restrictions, rate limits, eligibility rules, geographic restrictions, fraud detection, or security measures; interfere with, disrupt, overload, or degrade the Service or any networks connected to it; or encourage, enable, instruct, or facilitate any unlawful, harmful, fraudulent, or abusive conduct.

If Roamo blocks or restricts your access to the Service, including by blocking an IP address, account, device, payment method, email address, or other identifier, you agree not to attempt to circumvent such restriction, including through VPNs, proxies, alternate accounts, alternate payment methods, device changes, or other evasion techniques. Roamo may investigate suspected violations of these Terms and may remove content, suspend or terminate accounts, restrict access, preserve records, report misconduct to law enforcement or affected third parties, and take any other action we deem appropriate.

You retain ownership of the trips, notes, messages, preferences, reviews, uploaded content, itinerary details, saved places, and other content you submit, create, upload, or make available through the Service (“User Content”). You represent and warrant that you have all rights necessary to provide your User Content and that your User Content does not violate any law, third-party right, or these Terms. You are solely responsible for your User Content, including its accuracy, legality, reliability, quality, and appropriateness.

You grant Roamo a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, transmit, display, modify, format, translate, analyze, and use your User Content solely as reasonably necessary to operate, provide, secure, personalize, maintain, support, troubleshoot, and improve the Service, including to generate AI-powered features you request, render shared trips, provide recommendations, detect abuse, comply with legal obligations, and provide customer support. Roamo will not publicly display your private trips or private User Content except as directed by you, required to provide the Service, required by law, necessary to protect rights or safety, or permitted under our Privacy Policy.

Roamo may use aggregated, de-identified, anonymized, or derived usage data, interaction data, metadata, performance data, ranking data, search data, prompt-performance data, feedback data, and analytics relating to use of the Service to operate, improve, secure, personalize, measure, and develop the Service, including improving recommendations, retrieval systems, ranking, prompts, safety systems, abuse detection, maps, itinerary quality, user experience, and AI-assisted features. Roamo will handle personal data in accordance with our Privacy Policy.

If you provide feedback, suggestions, ideas, comments, reviews, bug reports, feature requests, improvements, or other submissions relating to the Service, you agree that such submissions are non-confidential and that Roamo may use, disclose, reproduce, modify, commercialize, incorporate, or otherwise exploit them for any purpose without restriction, attribution, compensation, or obligation to you.

Roamo may preserve, access, review, remove, restrict, disclose, or transfer User Content, account information, logs, usage data, technical data, payment-related metadata, or other information if we believe in good faith that doing so is reasonably necessary to comply with applicable law, legal process, court order, government request, law enforcement request, regulatory request, sanctions screening, tax obligations, or payment obligations; enforce these Terms or other policies; investigate fraud, abuse, security incidents, unauthorized access, spam, scraping, or misuse; detect, prevent, or address technical issues; respond to claims that content violates third-party rights; protect the rights, property, privacy, safety, or security of Roamo, users, partners, service providers, third parties, or the public; or operate and maintain the Service.

The Service, including its software, source code, object code, interfaces, design, visual elements, graphics, logos, trademarks, service marks, trade names, text, data, databases, travel intelligence, ranking methods, recommendation systems, AI workflows, prompts, retrieval systems, maps, layouts, and other content or materials made available by Roamo, excluding User Content, is owned by Roamo or its licensors and is protected by copyright, trademark, trade secret, patent, database, and other intellectual-property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, rent, lease, loan, license, sublicense, publicly display, publicly perform, create derivative works from, frame, scrape, extract, reverse engineer, or otherwise use the Service or any Service content without our prior written consent. Nothing in these Terms grants you any right to use Roamo’s name, logo, branding, trademarks, domain names, product names, or other brand features without our prior written permission. All goodwill arising from use of Roamo’s marks will inure exclusively to Roamo.

If you believe that content available through the Service infringes your copyright or other intellectual-property rights, please contact us at support@roamo.ai with a notice containing: your name and contact details; identification of the copyrighted work or intellectual property claimed to be infringed; identification of the allegedly infringing content and where it is located on the Service; a statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law; a statement that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder; and your physical or electronic signature. Roamo may remove or disable access to allegedly infringing content and may terminate or restrict accounts of repeat infringers or users who violate intellectual-property rights.

Certain features of the Service may use or display maps, geocoding, routing, location-based services, places data, business listings, navigation links, reviews, photos, or other third-party information provided by services such as Google Maps, Google Places, OpenStreetMap, Mapbox, Stay22, Travelpayouts, Stripe, Supabase, AI providers, OAuth providers, analytics providers, booking partners, or other providers. Your use of those features may be subject to the applicable third party’s terms, privacy policies, licenses, usage restrictions, and data practices. Roamo does not control and is not responsible for the accuracy, availability, reliability, completeness, legality, privacy practices, security, performance, or policies of Third-Party Services. You are responsible for reviewing and complying with all applicable third-party terms and policies.

Roamo may modify, suspend, discontinue, replace, limit, or remove the Service, or any part of it, at any time, with or without notice. Roamo will not be liable to you or any third party for any modification, suspension, discontinuation, loss of access, feature change, limitation, removal, or unavailability of the Service. We may also update, change, restrict, or remove any content, feature, route, integration, AI model, provider, data source, booking partner, map provider, or payment processor at any time.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Roamo expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, uninterrupted operation, error-free operation, suitability for travel, suitability for children, suitability for religious needs, suitability for accessibility needs, or suitability for any particular destination or itinerary. Roamo does not warrant that the Service will meet your requirements; that the Service will be available, uninterrupted, timely, secure, or error-free; that AI outputs, recommendations, maps, travel information, third-party information, prices, routes, opening hours, ratings, reviews, images, or availability will be accurate, complete, current, lawful, safe, or reliable; that defects will be corrected; or that the Service will be free from viruses, harmful components, or unauthorized access.

To the maximum extent permitted by applicable law, Roamo and its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, partners, suppliers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; loss of profits; loss of revenue; loss of business; loss of goodwill; loss of data; loss of use; loss of opportunity; travel costs; replacement services; booking costs; cancellation costs; rebooking costs; accommodation costs; transportation costs; visa or entry-related losses; medical costs; emotional distress; personal injury; property damage; or other losses arising out of or related to your use of, or inability to use, the Service, AI-generated content, third-party information, Third-Party Services, bookings, payments, recommendations, itineraries, maps, travel content, or any matter relating to the Service, whether based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, even if Roamo has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, Roamo’s total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to Roamo for the Service during the twelve (12) months preceding the event giving rise to the claim, excluding any amounts paid to booking partners, hotels, travel suppliers, payment processors, third-party providers, or other third parties; or (b) one hundred United States dollars (USD 100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. If any limitation or exclusion is found unenforceable, it will apply to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Roamo and its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, partners, suppliers, and representatives from and against any claims, demands, actions, proceedings, damages, losses, liabilities, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: your access to or use of the Service; your misuse of the Service; your User Content; your violation of these Terms; your violation of any law, regulation, or third-party right; your bookings, purchases, payments, cancellations, refunds, credits, changes, rebookings, or other interactions with third-party providers; your reliance on AI-generated content or travel information; your fraud, negligence, willful misconduct, or abusive conduct; or any dispute between you and any third party. Roamo reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any claim in a manner that imposes any obligation, liability, admission, or restriction on Roamo without our prior written consent.

You may stop using the Service at any time. You may request deletion of your account by contacting support@roamo.ai, subject to our Privacy Policy, legal obligations, fraud prevention, security needs, backup retention, dispute resolution, accounting, tax, and legitimate business needs. Roamo may suspend, restrict, or terminate your account or access to the Service, remove or disable User Content, cancel benefits, revoke promotions, or take other appropriate action at any time if we believe that you violated these Terms, created risk or potential legal exposure, misused the Service, engaged in fraud or abuse, infringed third-party rights, violated law, threatened the security or integrity of the Service, or if continued access would be harmful to Roamo, users, partners, or the public. Roamo may also terminate or archive inactive accounts or discontinue the Service or any part of it. Roamo will not be liable to you or any third party for any suspension, restriction, termination, deletion, removal, or discontinuation.

You are solely responsible for your interactions with other users, including users with whom you share trips, itineraries, notes, travel plans, bookings, or other information. Roamo has no obligation to monitor or become involved in disputes between users, but may do so at its discretion. You release Roamo from any claims, demands, damages, losses, liabilities, costs, or expenses arising out of or related to user disputes or interactions.

We may update these Terms from time to time. If we make material changes, we may notify you by posting the updated Terms on the Service, updating the “Last Updated” date, sending an email, displaying a notice, or using other reasonable means. Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

Before filing any claim or initiating any legal proceeding against Roamo, you agree to first contact Roamo at support@roamo.ai and provide a written description of the nature and basis of your claim and the specific relief sought. The parties will attempt in good faith to resolve the dispute informally for thirty (30) days after Roamo receives your notice, unless immediate legal action is required by law or to prevent irreparable harm.

These Terms and any dispute, claim, controversy, or proceeding arising out of or relating to these Terms, the Service, your use of the Service, AI-generated content, third-party information, subscriptions, payments, or any relationship between you and Roamo will be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict-of-law principles. To the maximum extent permitted by applicable law, the sole and exclusive jurisdiction and venue for any such dispute, claim, controversy, or proceeding shall be the competent District Court in Haifa, Israel only. You and Roamo consent to the personal jurisdiction and exclusive venue of that court and waive any objection based on inconvenient forum, venue, or lack of jurisdiction, except where mandatory consumer-protection laws in your jurisdiction provide otherwise and cannot be waived.

These Terms, together with the Privacy Policy, Cookie Policy, and any additional feature-specific terms, constitute the entire agreement between you and Roamo regarding the Service and supersede all prior or contemporaneous agreements, understandings, communications, or representations relating to the Service. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. Roamo’s failure to enforce any provision of these Terms will not constitute a waiver of that provision or any other provision. You may not assign or transfer these Terms or your rights or obligations under them without Roamo’s prior written consent. Roamo may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, or by operation of law.

Roamo will not be liable for any delay, failure, interruption, unavailability, loss, or damage caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, government actions, sanctions, embargoes, power failures, internet outages, network failures, cloud provider failures, payment processor failures, third-party API failures, AI provider failures, cyberattacks, denial-of-service attacks, security incidents, or failures of hotels, booking partners, travel suppliers, transportation providers, or other third parties.

Notices to you may be provided by email, through the Service, by posting on the website, or by other reasonable means. Notices to Roamo must be sent to support@roamo.ai unless another address is expressly provided. Section headings are for convenience only and do not affect interpretation. The words “including” and “include” mean “including without limitation.” The English version of these Terms will control over any translated version, except where applicable law requires otherwise.
